Do You Need a Notary for an Electronically Signed Document?

Signing and notarizing do different jobs

Your signature records your act of signing. A notary performs a separate authorized act, with its own procedures and certificate. Adding a scanned notary stamp to a PDF is not a substitute for that act, and a date next to your signature does not create notarization.

Start by reading the document's instructions. Look for a notarial certificate, acknowledgment, jurat, witness block or direction to appear before an authorized person. If you are unsure, ask the receiving organization which procedure it accepts before adding a signature.

Does an electronic signature create a new notary requirement?

Not by itself. Nor does it cancel a requirement associated with the document. A routine acceptance letter can have a different process from a sworn statement or property instrument. Requirements vary by location and transaction, so avoid lists claiming that every lease needs a notary or that no online contract ever does.

For example, Texas distinguishes electronic and online notarization. An authorized notary's procedures, seal and certificate are separate from an ordinary visual e-signature. That example is not a rule for every US state or another country.

What about remote online notarization?

Remote notarization uses an authorized process rather than simply emailing a signed file. The Texas Secretary of State describes online notaries as commissioned notaries authorized to act using audio-visual conferencing. Eligibility, identification and records are governed by that jurisdiction's rules.

If remote notarization is permitted for your document, confirm that the provider and notary are authorized, that the recipient accepts the result and that you understand the identification steps. Do not sign in advance if the process requires you to sign during the session.

Witnesses are not necessarily notaries

A witness and a notary can serve different roles. Do not replace one with the other unless the applicable rules allow it. In England and Wales, HM Land Registry's deed guidance discusses physical-presence requirements for witnesses, including electronic signing. A video call is not automatically sufficient.

Document labels can also be misleading. A file called “agreement.pdf” might actually be drafted as a deed. Read its execution clauses and ask about formalities instead of choosing a process from the filename.

A practical decision sequence

  1. Identify the document, its governing jurisdiction and where it will be submitted.
  2. Check whether the recipient requires notarization, witnessing or a prescribed signing service.
  3. Ask an authorized notary or qualified legal adviser about the permitted execution method.
  4. Follow the required signing order; leave notarial fields to the authorized person.
  5. Keep the completed document and any records provided by the official process.

Where Way2Sign fits

Way2Sign can place visual signatures and text on documents. It is not a notary service, identity-verification provider or remote-notarization platform. Use it only where that visual signing workflow is appropriate and accepted. If your document needs notarization, arrange that separately and follow the notary's instructions.

Common questions

Can I notarize a PDF by adding a notary stamp image?

No. An image alone does not perform a notarial act or satisfy the authorized procedure.

Is a witness the same as a notary?

Not necessarily. Their roles and qualifications differ, and a document may require one, both or neither.

Can Way2Sign notarize my document?

No. Way2Sign adds visual signatures and text; it does not perform notarization or remote online notarization.
